Throughout these terms and conditions, when we refer to 'we', 'us', 'our' or 'the Company', we are referring to The Yard and theyardscotland.org.uk. When we refer to 'you', we are referring to the user or browser of this website, or the membership paying participant.

These terms and conditions include general terms and conditions for use of this site, terms and conditions relating to the services provided by The Yard on the site and in the centre. Please read these terms and conditions carefully, your use of the site, the purchase of any products or services on this site will be subject to these terms and conditions. By browsing or using the website you are accepting these terms and conditions. If you do not accept these terms and conditions or any part of them, you should stop using the website immediately.

1. The Yard will not be liable for any losses incurred by you in connection with your use of the website, for any delay in using or your inability to use the website, for any information or products obtained through the website.

2. The Yard's website is for your own personal and non-commercial use. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, licence, create derivative works from, transfer or sell any information obtained from the website.

3. All contents of the website including any software, are protected by intellectual property rights and other related rights. No part of the website may be reproduced in any form (electronically or otherwise) without prior consent of The Yard.

You are not permitted to link to or use all or any part of The Yard's website for any reason which is unlawful, defamatory, harmful, obscene or objectionable and, in particular, you are not permitted to transmit anything which in The Yard's opinion harms our business or in any way offends other users or persons.

5. The Yard makes no representation, endorsement or warranty as to the accuracy of the information contained in the website. To the best of our knowledge the information on the website is accurate and correct. We reserve the right to change information on the website and will do our best to keep the information on the website accurate and up to date.

6. You are not permitted to alter The Yard's website in any way or post onto or transmit to the site, any material containing software viruses or files which may damage or disrupt the good working order of computer or telecommunications equipment.

7. The Yard may suspend the operation of this site for repair or maintenance work or in order to update or upgrade the contents or functionality of the site from time to time.

Membership

These terms and conditions relate to the purchase of membership online.

1. Memberships are non transferable and all members are issued with an individual membership card and key fob which is bar coded.

2. All memberships are non refundable. However members can cancel their membership at any time in writing by giving one month's notice. Cancellations should be sent to [email protected], 0131 476 4506 or posted to The Yard, 22 Eyre Place Lane, Edinburgh EH3 5EH.

3. Information displayed on the site or in the centre about membership prices is subject to change by The Yard without notice.

Sunday Funday supporters’ card

By holding The Yard Sunday Funday supporters' card you agree to be bound by the following terms and conditions. The Yard Sunday Funday supporters’ card (“card”) offers simple discounts for regular Sunday Funday visitors.

1. The card is to be held by a parent, guardian or carer on behalf of the child (must be over 18).

2. Your card is valid only for Sunday Funday and is not currently valid online.

3. Each card can only be registered to one child, and only one card is permitted per child. Keep your card safe – The Yard cannot be held liable for lost, stolen or damaged cards, or the loss of benefits linked to that card.

4. Your card must be shown at reception when you arrive and sign in.

5. Your card will be stamped with each visit to Sunday Funday. When you have had five stamps you will receive a voucher (£2.50) for coffee and snacks. When you have reached ten visits, you will receive free entry for one child for a regular two-hour visit.

6. A card cannot be used in conjunction with any other offer from The Yard. Accumulated stamps per customer and benefits cannot be consolidated onto a single card.

7. The benefits of a card cannot be used in conjunction with any other offer (unless specified in communications). The Yard reserves the right to exclude benefits of a card on special promotional days. Please read communications about these events carefully.

8. Rewards cannot be used for the purchase of gift vouchers, and cannot be redeemed for cash.

9. The card is for the personal use by customers, and cannot be used for any business or commercial purpose.

10. Use of a card does not constitute proof of purchase.

11. The card is free and remains the property of The Yard.

12. The Yard reserves the right to amend Terms and Conditions relating to the card at any time, including the cancellation of the card and any benefits, if necessary.
